TELECOM - Brazilian Senate passes bill to open cable TV market to phone companies

On August, 16th, the Brazilian Senate passed a bill (PLC 116/2010) to open the cable TV market to phone companies. It is now waiting for the signature of Brazilian President Dilma Rousseff, who endorses the measure. 

Basically, PLC 116/2010 establishes an entirely new legal framework for Brazil's telecommunication systems, since it modifies and unifies all regulations related to Pay TV (cable TV, MMDS, DTH and TVA). Amongst its top innovations, it is worth mentioning the partial revoke of the Brazilian Cable TV Act, the allowance for telephone companies to operate cable TV, and the establishment of national and regional content quotes to be broadcasted by cable TV carriers.

OIL & GAS: Brazilian Development Bank (BNDES) launches support program for the oil & gas sector supply chain


The BNDES approved the creation of the Support Program for the Development of the Supply Chain for Oil & Gas sector-related Goods and Services (BNDES P&G). The program offers the BNDES new ways to support the supply chain of oil & gas goods and services, narrowing the relationship existing between the Bank and the sector.


The high volume of investments expected for the coming years shows a favorable panorama to consolidate the oil & gas sector supply chain, with heightened competitiveness of Brazilian companies in the domestic and international markets. 

With a budget of R$ 4 billion and effective until December 31, 2015, the BNDES P&G aims to remove some of the obstacles to the sector’s competitiveness and development, such as difficult access to credit, high capital cost and access to state-of-the-art technology. 

The program focuses on projects undergoing implementation, expansion and modernization of production capacity; supply chain consolidation, merger and acquisition, and internationalization; financing of working capital required to produce equipments and render services; and support for research, development and innovation activities.

Besides offering different financial conditions, with interest rates ranging from 4.5% per annum, for innovation, to 11.04%, for financing working capital, in direct operations, the program eases access to credit for micro, small and medium-sized companies (MPMEs). Smaller companies represent approximately 85% of O&G supply chain companies in the country.

The program also outlines higher levels for the BNDES’ participation in financing projects and enables support for the acquisition of technology, manpower qualification and capacity-building and services rendering, especially sector-related engineering and certification services.

The BNDES P&G may also support the supply chain by means of operations with the so-called “anchor companies”. In this case, the idea is to ease access to credit for smaller companies (MPMEs).

The anchor company is a larger-sized company (with annual gross operating income over R$ 90 million) that, based on a Suppliers Development Plan, forwards at least 30% of financing resources to its suppliers and sub-suppliers, boosting production activities in which it is direct or indirectly involved. These operations are expected to foster an even closer relationship among the sector’s companies, in addition to enabling access to credit throughout the entire O&G supply chain.

BNDES P&G’s clients are all companies with head offices and management in Brazil, which integrate, or will in the future, the supply chain of oil & gas sector-related goods and services.

The BNDES P&G may operate with financing, in direct, indirect (by means of accredited financial institutions) or mixed modalities, and with variable income instruments, involving corporate stakes (shares).

ENERGY: Brazilian Agency's about to launch Notice to bid for auction re. electric energy transmission lines.

Notice with Invitation to Bid for the auction that aims to grant to private enterprise the concession of the right to exploit electric energy transmission lines will be published today at the Brazilian Official Gazette by the Brazilian Electric Energy Agency (ANNEL). Brazilian or foreign legal entities that meet the qualification requirements of the Notice may participate in the Auction, either individually or in a consortium.

The draft of the Notice that was approved yesterday by ANEEL’s board establishes that the auction will offer 12 line lots covering 2,051Km and substations with 6900 MVA. ANEEL expects that the full investment amount reaches up to R$2.8 billion.

The Auction will be held on 2 September 2011, at 10:00, at the headquarters of BM&F BOVESPA – Securities, Commodities and Futures Exchange of São Paulo (Rua XV de novembro, 275, Centro, São Paulo/SP).

AIRPORTS CONCESSION - Brazilian Aviation Agency (ANAC) launches CFP re. concessions of 3 major airports

On July, 25th, ANAC launched a Call for Projects (CFP) addressed to national and international companies interested in submitting projects for structuring the concession for expansion, maintenance and operation of the airports in Brasilia (JK), Campinas (Viracopos) and Guarulhos (Guarulhos International). 


The Agency expects to receive technical studies addressing best practices in airport infrastructure to the concession of the three largest Brazilian airports. 
The projects shall contain at least the following: market studies, environmental impact studies, engineering preliminary, economic and financial evaluation. The studies shall be submitted to all airports or individually. ANAC may approve or reject all or any of them.

If any study will be used by ANAC in the concession bidding process, its author shall be paid by the concessionaire. 


Companies have 10 business days from July 25th to express their interest on that CFP.
